ERISA Update: Does Montanile entirely change the game?

The webinar will focus on Montanile v. Board of Trustees of the Nat’l Elevator Industry Health Benefit Plan, 577 U.S. (2016). This new Supreme Court decision returns leverage to the Plaintiffs when dealing with ERISA plans that refuse to negotiate. David will interpret the case, and explain how to successfully use it to a client’s advantage, and the ramifications for applying it incorrectly.

David has extensive experience with ERISA, HIPAA, FEHBA, Medicare, and Medicaid. He spent three years as Associate General Counsel for the largest post-payment health care recovery vendor in the United States. During that time, he resolved hundreds of subrogation and reimbursement claims, advised medical benefits plans on issues such as plan language and recovery tactics and managed litigation matters.
