Summary

While rumors swirl about Medicare making new rules and regulations around Medicare Set-Asides (MSAs) in 2019, it’s important to understand the existing statutory framework upon which any regulations will be built.

Although most practitioners have looked at MSAs from the “requirement” perspective over the years, the Medicare Secondary Payer (MSP) Act has provided Medicare with this right for years, and that right may have nothing to do with MSA “requirements.”
