Surviving Challenges of Medical Bills
Published by New Jersey Association for Justice and New Hampshire Association for Justice

Summary
When it becomes necessary to address the damages incurred because of injuries from an personal injury, a physician, who testifies to necessity and causality, is usually the choice as the expert. It seems to make sense that physicians would know the reasonable charges for the care they provide. Usually this opinion is challenged. While the judge, mediator, and juries understand medical care is expensive and often inflated., the plaintiff attorney has no alternative in the past but to rely on the physician testimony for recovery of the medical expenses. It has become imperative for attorneys to understand the importance of a bill audit to prepare for claims of overcharging, undercharging, incorrect billing practices, and to obtain the best recovery of medical charges resulting from the client’s care.

Learning Objectives:
1. Identify areas of your practice where a billing audit would be beneficial.
2. Identify necessary plaintiff medical records and bills that will be needed by the auditor/reviewer.
3. Learn how to discuss the billing audit at mediation.
